The SettleIn Mutual Agreement

What we commit to, and what we ask in return.

SettleIn commits to

You commit to

  • Providing accurate profile and listing information.
  • Respecting other users' privacy and co-living preferences.
  • Not scraping, boting, or abusing the platform.
  • Reporting bad actors and fraudulent listings via the app.
  • Handling other users' contact details responsibly.
  • Adhering to India's Digital Personal Data Protection Act.

1. Acceptance of Terms

By creating a SettleIn account, logging in, or accessing any part of the platform — including browsing room listings without an account — you confirm that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms") and our Privacy Policy.

If you use SettleIn on behalf of an organisation, you warrant that you have authority to bind that organisation to these Terms. If you do not agree to any part of these Terms, you must discontinue use immediately.

These Terms are governed by the laws of India, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023. Disputes are subject to the exclusive jurisdiction of competent courts in Bangalore, Karnataka, India.

2. Eligibility & Account Registration

  • Age: You must be at least 18 years of age to create a SettleIn account and list or search for accommodation. We do not knowingly collect data from minors.
  • Accuracy: You must provide truthful, accurate, and complete information during registration and profile creation. False accounts, impersonation, and misrepresentation of properties are prohibited.
  • Security: You are solely responsible for maintaining the confidentiality of your account credentials. All activity performed under your account is your responsibility. Notify us immediately at legal@settlein.in if you suspect unauthorised access.
  • One account per person: Operating multiple SettleIn accounts for the same individual is prohibited unless expressly authorised in writing by SettleIn.

3. Platform Role & Listings

SettleIn is a marketplace and matching platform. We connect tenants with landlords, roommates with each other, and users with local service providers. We are not a party to any rental agreement, tenancy contract, roommate arrangement, or service delivery contract.

  • Landlords & Property Owners: You are solely responsible for the accuracy of your listing, compliance with local tenancy laws, collection of deposits, and execution of rental agreements. SettleIn does not hold, manage, or arbitrate security deposits.
  • Tenants: You must independently verify property details, landlord identity, and lease terms before entering into any agreement. SettleIn safety scores and reviews are community-generated and do not constitute professional endorsement.
  • Local Services: Tiffin, laundry, and housekeeping services listed on SettleIn are provided by independent third-party operators. SettleIn vets providers but is not responsible for service quality, delays, or disputes. Contact us at support@settlein.in to report a service complaint.
  • Roommate Matching: Compatibility scores are computed from the preferences you voluntarily disclose. SettleIn does not guarantee compatibility, personal safety, or co-living outcomes.

4. Code of Conduct

All users of SettleIn are expected to interact respectfully and honestly. The following conduct is strictly prohibited and may result in immediate account suspension or permanent ban:

  • Posting false, misleading, or duplicate room listings.
  • Harassment, hate speech, discrimination, or threatening messages toward any user.
  • Sharing another user's personal contact details (phone number, email, address) outside the platform without their explicit consent.
  • Using automated bots, scrapers, or scripts to extract room listings or user profiles.
  • Attempting to circumvent SettleIn's matching or payment systems (e.g., taking deals offline to avoid platform verification).
  • Creating fake reviews or rating another user's listing or profile dishonestly.
  • Using the platform for any unlawful purpose, including fraud, money laundering, or human trafficking.

5. User-Generated Content

By submitting content to SettleIn — including photos, listing descriptions, roommate bios, area reviews, and ratings — you grant SettleIn a non-exclusive, worldwide, royalty-free licence to display, reproduce, and moderate that content within the platform.

  • You retain ownership of all content you submit.
  • You represent that you have the right to post the content and that it does not infringe any third-party copyright, trademark, or privacy right.
  • SettleIn reserves the right to remove any content that violates these Terms, is reported by other users, or is otherwise deemed harmful.
  • Photo uploads are stored securely. Deleted listings have associated photos removed within 30 days. See our Privacy Policy for full retention details.

6. Intellectual Property

All software, design systems, algorithms (including commute intelligence and roommate compatibility engines), logos, trademarks, and documentation on SettleIn are the exclusive intellectual property of SettleIn Technologies Pvt. Ltd. and protected under applicable Indian and international law.

  • You may not copy, reverse-engineer, reproduce, or create derivative works from any part of the platform.
  • The SettleIn brand name, logo, and taglines may not be used in any external marketing, press releases, or social media posts without prior written permission.
  • Violating our intellectual property rights may result in civil and criminal liability under the Copyright Act, 1957 and the Information Technology Act, 2000.

7. Data Privacy Obligations

Both SettleIn and our users have data privacy obligations under India's Digital Personal Data Protection Act, 2023 (DPDP Act).

  • SettleIn's obligations: We collect only the minimum data necessary, process it lawfully, provide transparent notice, and honour your rights (access, correction, erasure, nomination). Full details in our Privacy Policy.
  • User obligations:You must not collect, store, or misuse other users' personal data obtained through the platform. Sharing contact information without consent, scraping profiles, or using data for unsolicited marketing is a breach of these Terms and may violate the DPDP Act.
  • Landlords as data principals:If you collect tenants' personal details via the SettleIn platform (e.g., contact numbers shared during a confirmed match), you must handle that data responsibly and in compliance with the DPDP Act.

8. Account Suspension & Termination

  • By you: You may delete your account at any time via Privacy Center → My Data → Delete My Account. Per our Privacy Policy, data is soft-deleted immediately and permanently erased after 30 days.
  • By SettleIn: We reserve the right to suspend or permanently terminate any account that violates these Terms, without prior notice in cases of serious breach (fraud, harassment, scraping). For less severe violations, we will provide at least one warning.
  • Effect of termination: Upon termination, your right to access the platform ceases. Data deletion follows our standard retention schedule as detailed in the Privacy Policy. Active booking obligations remain in force.
  • Appeals: If you believe your account was suspended in error, contact legal@settlein.in within 14 days. We will review and respond within 7 business days.

9. Limitation of Liability

To the fullest extent permitted by applicable Indian law:

  • SettleIn is a facilitation platform and accepts no liability for the accuracy of room listings, landlord conduct, tenancy disputes, co-living conflicts, property damage, or personal injury during tenancy.
  • We are not liable for the performance, quality, or reliability of third-party local service providers (tiffin, laundry, housekeeping).
  • Our aggregate liability for any claim arising from use of SettleIn shall not exceed the greater of (a) INR 5,000 or (b) the total fees paid by you to SettleIn in the 3 months preceding the claim.
  • We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits or loss of data, even if advised of the possibility.

Nothing in these Terms limits liability for death, personal injury, or fraud caused by SettleIn's gross negligence or wilful misconduct.

10. Governing Law & Disputes

These Terms and all disputes arising from use of SettleIn are governed by the laws of India. The courts of Bangalore, Karnataka have exclusive jurisdiction over any dispute that cannot be resolved amicably.

We encourage users to attempt informal resolution first by contacting legal@settlein.in. For privacy-specific disputes, the Grievance Officer process described in our Privacy Policy applies.

If a provision of these Terms is found unenforceable, the remaining provisions continue in full force. Failure by SettleIn to enforce any provision is not a waiver of future enforcement rights.

These Terms may be updated as our service evolves or legal requirements change. We will notify registered users of material changes via email and an in-app banner at least 15 days in advance. Continued use of SettleIn after that date constitutes acceptance of the updated Terms.
